On April 7, 2009 the Board of Zoning Adjustment (
BZA) extended the period of validity for the zoning variances and special exception relief that was granted in June 11, 2007 by two years from its original expiration date of June 11, 2009 to June 11, 2011.
The Board stated that "The Applicant's inability to secure financing and the poor economic conditions in the District together with the Applicant's inability to secure all related government agency approvals by the expiration of the Order because of delays beyond the Applicant's control constitutes the 'good cause' required..." to justify the extension.
The Board notes in its Order that "the Applicant's plans for development of the site would be unchanged from those approved by the Board in its Order Dated June 11, 2007."
